Access and use of ELMASA'S portal (www.elmasa.org) attributes condition of USER, who accepts General Use Conditions set out herein, as well as specific conditions from said moment and which, in its case, may compliment, modify or substitute general conditions related to determined services and contents on de Web Site. Mentioned conditions will apply independently of The General Conditions which, in its case, result in legal compliance.

ELMASA may modify unilaterally and without previous warning, as long as ELMASA sees fit, structure and design of Web Site, as well as modification or elimination of services, contents and conditions and Access and or use of the fore mentioned.

User commits to using Web Site and its services and contents without contravening Current Legislation, good faith, generally accepted uses and Public Order.

Likewise, the use of The Web for illicit or damaging purposes against ELMASA, any Third Party, or that in any way, may cause damage or prevent normal Web Site functioning, is prohibited.

With regards to the contents (information, texts, graphs, sound and/or image files, photographs, designs, etc...) the following are prohibited:

• Any infringement of ELMASA's rights or Legitimate Owners' rights.
• Any use for all types of commercial or publicity uses, different to those strictly allowed.
• Any attempt to obtain contents from the Web Site by any means different to those made available to the user, as well as those normally made available and used on the net, as long as these do not cause damage to ELMASA's Web Site.

www.elmasa.org's pages can provide links to other contents, property of Third Parties. The only objective for these links is to provide the User with the possibility of complementing information via the fore mentioned Links. ELMASA does not have nor accepts responsibility in any case for results which may derive to The User for accessing to the fore mentioned Links.

ELMASA does not give any guarantee nor accepts responsibility in any case, to any damages or loss on any nature caused which my bring cause of:

• Lack of availability, maintenance and effective functioning of the Web Site and/or its services and contents.
• Lack of usefulness, adequateness or validity of the Web Site and/or its services and contents to satisfy needs, activities or concrete results or User expectative.
• The existence of viruses, malware or damaging programmes in its contents.
• Reception, extraction, storage, diffusion or transmission by Users of any of the contents.

The duration for the provision of the web site's service and its included services is indefinite.

In order to preserve possible Intellectual Property Rights, in case any User or Third Party considers that a violation of their legitimate rights has been infringed by inserting a determined content within the web site, the fore mentioned must notify said circumstance to ELMASA indicating:

• Personal data for the interested party, owner of the allegedly infringed rights. If claim is presented by a third party different to that of the interested party, the nature of the representation must be indicated.
• Indication of the protected contents by Intellectual Property Rights and its place within the web site.
• Credentials and certification for the fore mentioned Intellectual Property.
• Specific declaration in which The Interested Party takes on full responsibility for the truthfulness of all information given in the notification.

Intellectual or Industrial Property Right Legitimacy corresponding to the contents supplied by third parties is the sole responsibility of the fore mentioned Third Parties.

Present General Conditions will be regulated by spanish Legislation.

ELMASA and User expressly refuse rights to any Jurisdiction of the Courts and Tribunals of Madrid, for any issues which may arise or actions exercised, derived from rendering of the web site and its included services and contents, its interpretation, application, compliance or incompliance of all information laid out herein. In the case where the user has address outside Spain, ELMASA and User will expressly refuse any rights to Jurisdiction or Regional Code of Law and are solely subject to the Jurisdiction of the Courts and Tribunals of Madrid.

Current GDPR Policy regulates handling of all data collected by ELMASA OBRAS PÚBLICAS S.A. (hereafter, ELMASA) via its web site, even though specific sections or forms specifically regulate information obtained through these. This policy is an integral part of the legal notice.

The user guarantees that all information and data given is true, exact, complete and updated, user being responsible for any damage or loss, direct or indirect, which may arise as consequence of non-compliance with said obligation.

User's Personal Data collected via the web site will be added to files belonging to ELMASA with the end purpose of managing users and assisting thir request forms and queries.

In greater detail, ELMASA will be able to handls User's Data with the following purposes:

• User management, request forms and queries
• Newsletter distribution through any channel, including electronic means (such as email and web notifications on activities, own or third party events, tenders, which may have commercial information on products, services, offers or promotions related to activities carried out by ELMASA and/or its Group. All Companies or Entities which have ELMASA, as a Dominant Corporation within ELMASA Group and specifically, those Companies fundamentally carry out the following activities: (i) construction, (ii) machinery buying & selling, (iii) real estate and property buying & selling and (iv) services.
  
  Additionally, we inform on possible handling of User data for social networks throught Corporate Profiles belonging to ELMASA with the purposes allowed within each social network, including analytical purposes.

ELMASA informs you that your data can be communicated to the following entities: Group Companies identified in the previous section, to serve requiest forms and User queries.
Likewise, we inform you that your data could be communicated to Data Handling Managers.

The legal base for data handling and/or transfer is based on the user's consent.

Data will be kept during the following time frames and throughout the necessary years to comply with applicable legal obligations, in its case:

• Users who send request forms and/or querie: the time needed to manage these.
• Newsletter Subscription Users: as long as the user does not ask to be unsubscribed.

The user will be able to put a claim in at Agencia Española de Protección de Datos (https://www.agpd.es), specially when the user has not received satisfaction in his/her use of rights.
